The terms for using this site and buying equipment from us. Plain language where the law allows it.

These terms govern your use of hvaconsale.com and any purchase you make from HVAC On Sale ("we", "us"). By using the site or placing an order you agree to them. If you do not agree, please do not use the site.
1. Product information
Specifications, capacities, efficiency ratings and images come from the manufacturers and from the AHRI directory where applicable. We work to keep them accurate, but manufacturers change products without notice and errors happen. If a listed specification matters to your decision, ask us to confirm it before you buy. We may correct errors, including pricing errors, at any time, and may cancel an order placed against an obvious error with a full refund.
2. Quotes and pricing
Written quotes are valid for 14 days from the date sent unless the quote says otherwise. Prices, freight and availability can change after that. A quote becomes an order only when you approve it in writing and payment clears. Prices exclude installation, permits, sales tax where applicable, and any local fees.
3. Orders and payment
Payment is due in full before equipment ships. We accept major credit and debit cards and PayPal through our payment processor. Placing an order confirms that you are at least 18, that the payment method is yours, and that the shipping address is accurate. We may decline or cancel any order, for example when we cannot verify payment, when an item is no longer available, or when an address cannot be served by freight.
4. Shipping, delivery and risk of loss
Shipping is governed by our shipping policy. Title and risk of loss pass to you on delivery to your address. Inspecting the shipment and noting damage on the delivery receipt before signing is a condition of any damage claim.
5. Returns and refunds
Returns are governed by our return and refund policy, including the 30-day window, restocking fee and the list of items that cannot be returned.
6. Warranties
Equipment is covered by the manufacturer's written warranty, which is provided with the product and is between you and the manufacturer. To the fullest extent permitted by law, HVAC On Sale disclaims all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some states do not allow this disclaimer, so it may not apply to you in full. Nothing in these terms limits rights you have under law that cannot be waived.
7. Installation and codes
You are responsible for installation. HVAC installation in Florida must be performed by a state-licensed contractor, and most other states have similar requirements; local permits and inspections may be required. Manufacturers generally require licensed installation for the warranty to apply. Handling refrigerant requires EPA Section 608 certification. We are not liable for injury, property damage or warranty denial arising from installation, whoever performs it.
8. Sizing and recommendations
Any sizing or equipment recommendation we provide is based on the information you give us and is offered in good faith to help you choose. It does not replace a load calculation and site inspection by your installer, who is responsible for confirming the equipment is right for the building.
9. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim related to the site or an order is limited to the amount you paid us for the equipment giving rise to the claim. We are not liable for indirect, incidental, consequential or special damages, including lost profits, loss of use, spoiled goods, or the cost of substitute equipment or emergency service, even if we were told they were possible.
10. Use of the site
You may use the site to learn about and buy equipment for yourself or your business. You may not scrape it for competing commercial use, attempt to interfere with its operation, or submit false or abusive content through its forms. Content on the site, including text, page design and our logo, belongs to HVAC On Sale or its licensors. Manufacturer names, logos and product images belong to their owners and are used to identify their products.
11. Third-party links
The site may link to manufacturer sites, warranty registration pages and other third parties. We are not responsible for their content or policies.
12. Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute that cannot be resolved by talking it through will be brought in the state or federal courts located in Escambia County, Florida, and you consent to their jurisdiction. If any part of these terms is found unenforceable, the rest remains in effect.
13. Changes
We may update these terms by posting a new version here with a new effective date. The terms in effect when you place an order apply to that order.
